I bought my house prior to getting married. It never became marital property. I want to put it on the market in April but my husband and I will still be enduring the one year separation at that time. How can I sell it without it being considered marital property, or without my husband receiving any profit from it?
You will need to execute a separation agreement and property settlement in which your husband waives any and all right in and to the home. Even though the home is your separate property, your husband does have certain rights to the property as a consequence of the property being used as the marital residence, and as a result of his current status as your spouse.
