There were motions filed against each other, and I was 9 minutes late into the courtroom. I’m pro se. My motions were dismissed with prejudice, and the opposing attorney withdrew his motion to compel and motions for a protective order (to prevent me from being able to ask for a discovery request). However, he re calendared his motions to be heard 3 weeks later. Can he do this, or must he re-file a new motion since he withdrew his?
If he did not dismiss his motions but only took them off the calendar, then he only needs to calendar them again. He shouldn’t have to file the motion again.
