from what you said its marital, If the injury happened prior to the marriage you may be able to get it classified as seperate. Workers comp is money paid that you would have earned if you had not been injured if you had been working those three years your salary would be maritable asset as well. (as is hers)

What if you had a surgery that was unneccessary during your marriage and you received a settlement 2 yrs after separation is the other party entitled to the money as well.

Are workers comp settlements considered marital assets?

Case in point, Husband injures his back, out of work for 3 years, settles for $xxx,xxx. Now couple is having problems. Money is in the bank in husbands name only.
