Alcoholism and Equitable Distribution

Could I get more than 50% of equitable distribution if my husband is an alcoholic and a cheater? I’m disabled with a small amount of ssdi each month.

Generally no, unless you could prove that there was marital waste of assets to further your husband’s drinking and cheating. Marital misconduct is not considered in equitable distribution.

In contrast, illicit sexual behavior is considered in alimony and can affect to your benefit your ability to receive alimony.
