Alienation of Affection

The woman I’m currently dating is concerned about being sued by my “wife” for alienation of affection. I established a separate domicile about 2 months before meeting and dating this woman. I have an apartment lease, utilities, banking accounts, car loan, etc. all coming to my new residence. Does she have any grounds to be concerned?

So long as you have clear proof that your relationship began while after you have separated, then your girlfriend shouldn’t face liability. To learn the elements that must be proved to bring an alienation of affections claim, see our article: Infidelity and Alienation of Affection.
