Alimony and death of ex


You will need to petition the court where the alimony order was issued to obtain a decree ending your obligation. Your question is in no way insensitive, and I can imagine you are quite stunned by this news.

The court process to obtain a decree terminating alimony will not be complicated, and should go rather quickly.

I learned recently of the death of my ex. We were married and divorced in NC, yet I currently live in Tennessee. The divorce decree states that alimony will cease upon her remarriage or death. My question is this: Do I need to go to court in NC and petition for modification (termination) of alimony or is it automatic?

I don’t want to seem insensitive, but I’m rather dazed by this as it seems so surreal.
