This is the situation -
Husband moved out in March after announcing in January he wanted to separate. He left a dependent spouse with a special needs child. He stopped paying in May. He has had a girlfriend since 2022 and been pursuing her since 2019. There is proof of this. He refuses to stop coming to the house for his own use. He eats the food that he won’t buy, he says he’s on the lease so he has the right to come in whenever he wants.
Please help asap
Thank you
If Husband moved out of the marital residence, then he cannot come and go as he pleases. He needs the consent of Wife who remains in the marital residence, regardless of whose name is on the lease or deed.
Wife can change the locks to the marital residence since a separation has occurred.
