If I want to file bankruptcy because I can’t pay the mortgage on the house that we purchased together and he is living in, do I have to remove him from the property? My name is the only name on the loan, and his name is the only name on the deed…since the house is mine and the land is his, shouldn’t he be living outside? Ha!
Your question is better answered by a bankruptcy attorney, but I do not know of any requirement that for real estate to be contained in a bankrupcty that you must reside in the property.
