Change of Jurisdiction

NCP lives in NC. CP and children have resided in another state well for several years. If NC relinquishes continuing jurisdiction, does that mean both custody and child support would be in the new home state? If the new home state takes jurisdiction, does that also mean the new state’s child support guidelines are used in determing any modifications to child support going forward?

The rules for jurisdiction and changing jurisdiction are not the same for custody and support. Changing jurisdiction for custody does not automatically change it for support. If the noncustodial parent remains in NC, support jurisdiction should remain here.
