Good Morning -
I have a question about figuring child support. I co-own a business and make a set salary.
As one of the owners of the business I also get draws or bonuses when the business does well.
Does the bonuses or draws count towards the total figure of my salary since they are not guaranteed ?
I figure they do, just wanted to be sure.
Thanks in advance.
I believe they will look at several years of your tax returns to get an average salary. My ex made salary plus commission (which varied greatly). The courts used an average of 3 years tax statements on his salary to create an average that was used for child support.
Yes, bonus pay is included as gross income, and if the amount is uncertain a court will look to your past tax returns in order to have a better idea of what you will earn in bonus pay.
