Hi,

I have a question regarding some of the wording in Divorce Complaint. Under Plaintiff, complaining of Defendant alleges and says the following:

#7 reads “That there are no issues of child support, custody, alimony or equitable distribution pending between the parties as they have heretofore entered into a separation agreement that they wish to be incorporated into the divorce judgment”.

As I have changed my mind and do not intend to file Separation Agreement with the Court, can I just remove “that they wish to be incorporated into the divorce judgment”?? Would the wording then be sufficient when not submitting SA to the Court? Or should I change the wording entirely to read “there are no issues of child support, custody, alimony, or equitable distribution pending between the parties as they have heretofore been settled between the parties”?

If you do not wish to incorporate your agreement you may simply delete “ that they wish to be incorporated into the divorce judgment".
