My husband’s ex-wife has filed a contempt charge on him. The lawyer she is using represented me in a protective order and child support with my ex. Is this a conflict of interest? Also, can you make a motion, on the same day as court, to dismiss a civil contempt or does it have to be filed before going into court?
Whether or not a conflict exists would depend on whether you were involved with your husband at the time you were represented by this lawyer.
As for the motion to dismiss, if the ex is alleging that your husband is violating the order, the proper course of action is to appear and show cause as to why he is not in compliance, or to show that he is in fact complying with the order.
