Dear mikeb:

Greetings. Did you say “her lawyer” told you something. Her attorney represents her, not you. Hire your own attorney.

Yes, you are entitled to half of the marital portion of all retirement benefits acquired by either party during the marriage. You may also be entitled to alimony as a dependent spouse. Best of luck.

The response posted above is based upon the limited factual information made available and is not intended as a full and complete response to the question. The only reliable manner to obtain complete and adequate legal advice is to consult with an attorney, fully explain your situation, and allow the attorney sufficient opportunity to research the applicable law and facts required to render an accurate opinion. The basic information provided above is intended as a public service but a full discussion with an attorney should be undertaken before taking any action.

My wife and I are selling our home during our seperation, and spiltting the profits. Her lawyer said that this was part of my fair compensation as a dependent spouse. A friend also told me that I may be entitled to half her 401K plans while we have been married. Is this true? Thank You.
