The attorney you spoke too is correct, just because you are granted a divorce from Bed and Board does not mean your spouse will be evicted. If you do not believe your spouse will move out under any circumstances, you should discuss your rights and options if you leave the residence, that may be the easiest way to start the process. You should not leave unless and until you have discussed this specifically with an attorney.

Ok, I am confused. My understanding is that the way to get your spouse to move out of your house if they won’t move is to qualify for Divorce from Bed and Board and to file for it. I have determined that I do qualify for that via this website and an atty consultation. However, the atty I saw indicated that in Mecklenburg County, the divorce from B&B might be granted but that it didn’t mean that my stbx would be required to leave! HELP! I don’t know what to do now.
