My husband cheated on me and we want a divorce. We live in NC and must be separated one year apparently but he has no-where to go. How can we get a divorce or separation established if we still live under the same roof? He is not contesting the divorce. Also he is disabled on SSI and due to my income only receives 59$ a month, would this change if he did find a place to go?
Divorce requires physical separation with the intent to remain separated for a year and a day before you can file. Living in separate bedrooms isn’t sufficient.
