Emergency Custody - Mediation

I have a current emergency custody order but we are scheduled for mediation.

I suspect mother is still abusing prescription drugs.

I can’t believe we are forced to negotiate a parenting agreement under
this circumstance. Should I just negotiate to keep the order as is or nothing and go to court?

Should I present evidence at mediation of drug abuse or save it
for custody trial?

How long after mediation fails does a custody trial begin?

You should not agree to terms in mediation that you feel will provide less than a safe environment for your child. No evidence is formally presented in mediation, though you can voice your concerns to the mediator.

Depending on the county a trial is usually scheduled 1 to 3 months after failure of mediation.
