Forced Photo at DSS

Since I’m having a problem posting a new topic I’ll post it in yours, How long does it takes for Child Support Enforcement to enforce payment on the defendant, the order was given in Sept 06 and I haven’t recieved a payment yet and the enforcement agency has had all documentation since Sept 06. this is Durham Count I’m talking about.

Dear rigerator:

Greetings. DSS does not handle child support. I have not heard about this photo policy with the child support enforcement agency. Let me check on that with my fellow attorneys.

Dear FATHERDORIGHT:

I think, but I do not know, that the child support enforcement agency has a policy about late payments and no payments, but it can take them months/years to enforce. Best thing that you can do is file your own motion to show cause in the action. Thank you.

The response posted above is based upon the limited factual information made available and is not intended as a full and complete response to the question. The only reliable manner to obtain complete and adequate legal advice is to consult with an attorney, fully explain your situation, and allow the attorney sufficient opportunity to research the applicable law and facts required to render an accurate opinion. The basic information provided above is intended as a public service but a full discussion with an attorney should be undertaken before taking any action.

By filing a motion to show cause what will that do and will I need a lawyer to do it.

I do not know why DSS would want your photo, however we routinely take pictures of our client’s, it is helpful for me to have a face to put with a name, especially when we are meeting with many new clients on a monthly basis. It may have been as simple as that.

I recently received a summons from my local DSS office regarding modification of child support payments. When I went to the office, they tried to force me to have my photo taken before I would be allowed to speak with the case officer. When I refused, the case officer refused to see me and said he would just begin court proceedings.

Can they do that and why would they want to? I know of no law that mandates that I must submit to a photo, and since I have never missed a support payment, certainly my payment history would have no bearing. Frankly, it made me feel like a criminal. Thanks in advance for your response.
