Who Enforces Child Support?

I would file to get it garnished from his wages. If you have a support order, then you can contact NC Child Support Enforcement.

There is a court order for child support and yes, there is also an order for it to be garnished for his wages. However, he has changed jobs at (3) different schools since the order and child support enforcement is involved. The enforcement agency goes along with whatever his attorney says and doesn’t do a thing to enforce non-payment. Who enforces the child support agency?

Well, what in the heck is his attorney telling CSE?

I have my CS through NC Child Support Enforcement and I was told that it was the PAYERS responsibility to reset garnishments when a job change was done. That the CSE didn’t care WHERE the money came from as long as payment was made. My ex had to use a credit card one time while he was changing jobs. The CSE said any arrears would show up on my account and after a set time (I think 30 or 60 days), then the CSE would issue a show cause to the ex. I was told I would be completely out of the picture.

Luckily, I’ve never had arrears happen since we’ve had it set up. I can’t imagine what his lawyer would be telling the CSE so that they excuse the payments or don’t persue it. Can you log into the site and see your account? Does it show arrears?

The judge who is continuing this matter is probably not aware of all the facts. Have you been made aware in advance the last two times the case has been continued? You may want to call down to the courthouse and find out the procedure in Guilford for requesting a continuance, when you find out who his attorney is talking to, notify her in writing that you object to any further continuances and wish to be notified if he requests one.

You may also want to consider contacting Child Support enforcement, they can pursue enforcement of this order on your behalf.

I was notified one time about a continuance but the other 3 times I had taken the day off work, gone to Court and found out during that time. There are arrears of approximately $2500.00 owing currently, but it’s not doing me any good if it’s not being enforced.

I am also paying for afterschool care each week and my ex does not pay anything. Where is the justice?

There is nothing truer than the fact that the wheels of justice grind slowly. I am sorry you are having problems, hang in there, you will eventually have your day in court.

I feel for you. I have currently a little over $8,000 owed and it has been worse (oh, the horror stories I could tell), and rarely see a penny. You have to stay on CSE or you get lost in the stack of papers. You also have to remember that it is their JOB, and they aren’t looking at your child every night wondering about their future. But, with regards to who oversee CSE, each county DSS has a board and ususally at least one County Commissioner sits on that board and they are responsible to oversee how it runs. Also, if you get nowhere with your caseworker find out who their supervisor is, and talk to them.

Thank you so much for your response. What bothers me is the fact that no one seems to care about the children. This is truly about them. I alone can survive but the children need help. Sometimes it seems that no one cares and it is so very frustrating. I just pray that things go well when we go to court the latter part of October.

I can understand your frustration. I went through this for eight years with my ex. I can promise you it does get better but you have to be persistent. Don’t let your ex get by for one day without paying. Keep in touch with child support services, leave messages as much as it takes. If the person handling your case is not helping you, ask to speak to their supervisor. If you still don’t get help keep filing those motion to show cause. Believe me persistence pays off. I don’t let my ex get one day late without letting someone know about it whether its Child Support Services or dragging his butt to court to show cause. If they think you are gonna let it go they just keep taking advantage.

Well, I stated that I would keep you posted so here goes. Since custody was modified to the point that the ex husband got more custody by his very prejudiced attorney and judge, now he has motioned the court for a modification of child support. To him, it’s all about the money. God save the children

All I can say is this, Make sure he spends that time with the child. I am sorry to read and hear about your pain. Right now I am sitting at almost 11,000.00 in the arrears. Will I see it? No. He is enjoying life right now in Iraq, with no care in the world. There is nothing CSD can do. I got this one email from him stating that he wants a DNA done. lol Okay, 6 yrs have passed and now he wants a DNA. Crazy ppl.

I live in Guilford County. My ex husband has only made 2 child support payments since February. He has an excellent job as a school teacher and a praise and worship leader at his church. He will not pay half of any meds of take the children to the doctor. He does not buy clothing or other items needed by the children when they are with him. We currently have a joint custody arrangement. However, he pays one of the most expensive attorneys in Guilford County and each time his case comes up in child support, it is continued for a month or two. A show cause was served on him in July and his case has been carried over until the end of October. In the meanwhile, I the mother am facing eviction, struggling with feeding my children, make car payments, pay utilities, etc. As a matter of fact, I do work a full time job and don’t understand why no one will enforce his child support.
