I will be filing for divorce on the 17th of this month and assume it will be granted around the May-ish timeframe. Once the divorce is granted, am I required to notify my health insurance company that he is no longer a dependent on the plan (a “life event” as most plans call it)? Or can I continue carrying him through 2010, and then remove him from the plan for the 2011 enrollment period?
Also, he wants to stay on the plan and pay me directly for his share of the costs while I continue working there, rather than paying for the high COBRA insurance rates. I believe this to be insurance fraud but he says it is legal.
