Husband buying company

My husband and I are currently separated, potentially headed toward divorce. He is actively trying to purchase the commercial construction company that he has served as president. He would be using all of our personal assets (401K, Roth IRAs, etc.) It seems that everything is currently in his name and he has the ability to cash out savings at any time.

I do not want to prevent him from buying the company, I just want to protect what would be mine in a divorce. An attorney had mentioned an injunction, but I understood that to freeze all assets. Would I be able to prevent him from accessing just “my” half?


Not likely, as your half, or what you are entitled to will have to be determined through ED which requires a full analysis and valuation of all assets.
