Husband's judgement

As long as a couple is married and their residence is titled jointly as a “tenancy by the entirety” a judgment in the name of one party cannot be attached to the residence. If the house is titled to the Wife before the divorce, then it means that the judgment cannot be attached to the house and impact her interest. Thanks for listening.

How would I find out if my property is “tenacy by entirety”? And what does that mean?

Property deeded to a husband and wife is deeded as a tenancy by the entirety unless the deed specifically states otherwise.

I posted a question on the talk show this morning and I really did not understand the answer given. I was trying to listen and write at the same time! Is there any way that I could get it cleared up? My question was:

  • My ex and I will be getting our final divorce next month. I get the house,he gets another property. He will be signing a quick claim deed for the house, his name is on deed of trust only, not mortgage. My plan is to sell the house. He has a judgement againt him. Since his name is being removed from the deed and he does not get any equity from this property, will his judgement affect me on the sale of the house?
    I am confused as to what Helena stated.
