Is this spying?

Husband setup kids Ipad with wife’s email address. Husband and wife both know password. Wife logs into Icloud and finds it is linked to Husband’s phone. Wife finds emails, pictures, etc of adultry. Is this legal and admissable in divorce court? Is it legal to even login after discovering this?

Whether or not this would be considered a violation of state and federal wiretapping laws hinges on whether that was authorized access or not. And I can’t tell you what a judge would say given those facts (or any facts, for that matter). You could argue that this was authorized access based on the fact that his phone was linked to your email through the cloud, it isn’t like you guessed his phone password and were able to find incriminating details that way.
