we have a court date for modification of child support. Last year the ex-wife (the one who is receiving support) filed suit for modification and claimed that she was spending close to $300/month in child care expenses. That lasted one month after the order went into effect. Child has not been in day care since. Conveniently he WILL be in day care (summer) when we go to court over this modification. We can show proof that he was not in day care for the majority of last year. Will this be taken into account?
