Mortgage

Dear obxwillis:

Greetings. You need an agreement that describes when your name will be removed from the mortgage and how. You should not sign a quitclaim deed on the house over to your wife until the mortgage is out of your name. Best of luck.

The only reliable manner to obtain complete and adequate legal advice is to consult with an attorney, fully explain your situation, and allow the attorney sufficient opportunity to research the applicable law and facts required to render an accurate opinion. Am I required to keep or remove my name on the mortgage for the house my soon to be ex-wife and son will reside? If not, is there a law or past case in the state of NC that would indicate removal this. My preference is to have it removed.
