My ex had me served with a Motion to Show Cause. My attorney told me to ask him if he submitted an Order and if it was granted. I’ve asked 3 times via e-mail & gotten no response from him. I happened to do a search for something totally unrelated and saw that there is a court date scheduled for next week, but I haven’t received any notice of a court date and neither has my attorney. What is the proper way to receive notice? Should I ask for a continuance since I didn’t receive notice?
Since you are aware of the court date you do have actual notice, despite not being served with the Order to Show Cause (usually done by mail), I suggest you show up. The court may grant a continuance on the basis that you were not properly served notice.
