My wife and I have been living in separate rooms for the last 1 and a half. We went to separate from bed and board, but the judge dismissed both her claims. I was advice by another attorney to move out and pay the mortgage. Is this advisable? Since she could get me for abandonment.
You may move out if you wish and will not be “charged with abandonment” as there is not such claim. You do not have to move out if you do not want to.
