Don’t move in. Unless you can get the guy in prison to sign a third party waiver, then he can technically sue you for CC. Doesn’t matter if he’s separated from his wife. She is not divorced yet and you moving in shows opportunity and intent for CC.

He can sue me- what can he do to her?

Nothing, really…that I know of.

She can be arrested for the criminal offense of adultery.

Did I read that correctly? Can a spouse be arrested for adultry?

They could arrest her, but I seriously doubt that would happen. By NC laws, cohabitating with someone else’s spouse as if married is against the law. If they arrested people for doing that my stbx would be in the poky big time. I would love to make that happen. [}:)]

A sexual relationship with someone other than your spouse while you are still legally married is adultery and you can be criminally prosecuted for this offense. Each individual law enforcement agency is responsible for deciding whether to prosecute these offenses. The previous poster is correct that I rarely see these cases prosecuted.

My girlfriend and I are thinking about moving in together. Here’s the situation- she’s 6 months away from getting a divorce, and has children living with her. Can her husband (he’s in prison, btw) do anything legal to either one of us? We met about 6 months after they split up. This is what I’m concerned about:
