Hello I want to move away before my baby is born. My plan is to go to North Carolina to stay with a family friend. Can my baby’s father find me and still take me to court? I wish for him to stay away from me and especially my baby, I don’t feel safe with him and if I stay I know he will take me to court for dna and visitation.
Contact an attorney in the state you are currently residing to see if you would qualify for a protective order.
North Carolina can assume custody over the child for purposes of issuing a child custody order once the child has resided in North Carolina for six months (or from birth to age six months). Until then, your current state may still have jurisdiction for child custody actions, but I am not licensed in any state but North Carolina and cannot give legal advice about custody actions in any other state.
