The response posted above is based upon the limited factual information made available and is not intended as a full and complete response to the question. The only reliable manner to obtain complete and adequate legal advice is to consult with an attorney, fully explain your situation, and allow the attorney sufficient opportunity to research the applicable law and facts required to render an accurate opinion. The basic information provided above is intended as a public service but a full discussion with an attorney should be undertaken before taking any action.

I am in a sticky situation. My husband and I moved to NC almost 2 years ago and opened a business. We have poured every dime we have into the business (which includes a house for us to live in). We separated a couple of weeks ago, but are still working together in the business. I would like to move my children to Virginia to be near family and to give them opportunities that this very small town does not afford them. My question is: will I jeopardize a divorce settlement and property distribution by moving? Can my husband decide to continue to operate the business and only provide child support (but not any cash out of the business); and if we are in debt right now, can he not provide any support for the kids? I just need to know my legal rights before I make a move. Thank you.
