Our child was born in NC and is now 10 yrs old; therefore, all of my child’s life.

Greetings. Yes, it is legal for you to relocate to another state. By legal I mean that it is not against a criminal law. Remember though, your spouse may be able to file a claim for custody and ask the court to keep your child in the state of NC. Thank you.

My husband and I have recently separated. We are not legally separated. There is a child born of the marriage and he lives with me. My family lives in another state. I have no family in NC. His family also lives in another state. He has been ordered to pay child support. My child’s father does not make an effort to visit his child nor does he contact him. I normally take our child to visit with his father. My son does not like going to his father’s and I am always butting heads with him on the days that I take him over. Is it legal for me and my child to relocate to another state under these circumstances?
