Good morning. My divorce was finalized March 10, 2014 in Ireddell County, North Carolina. I did put in a claim for equitable distribution and in my Judgement Of Divorce it states : That issues of Equitable Distribution are reserved until such time as they can be heard by the court. : What does this mean? Do I wait for the court to set a date? Do I need to file any papers to the court? Thank you
You should familiarize yourself with the equitable distribution statute so that you understand the litigation process. You need to follow any local rules in your area as well as creating an equitable distribution affidavit per the statute. You also need to talk with the clerk about how to schedule any court dates including pre-trial conferences as well as the equitable distribution trial.
