Not wanting a divorce

My husband and I have been separated for 6-8 years different addresses, we were supposed to be reconciling, and are still intimately involved can he still get a divorce in the state of NC. I want us to try counseling but he seems to be against it.

If you are permanently maintaining separate addresses and residences, you are separated in NC. Physical acts of intimacy won’t negate that. You have to be holding yourself out as a married couple to the public to not be considered separated, and with you living in separate households, you are not holding yourself out in that way. If he chooses to file for divorce, it would likely be granted given the length of your separation.
