My spouse left in the beginning of the year 2021. Meanwhile, the selling of the home took place. Distribution was distributed for the sale. However, I received a refund check for the property taxes paid. Is the spouse who left the home entitled to any of that property tax refund?
If this is not addressed in a separation agreement or court order and the refund for the taxes was for 2021 taxes paid, then your spouse would be entitled to one-half of the marital portion. The marital portion would be from 1/1/21 to the date of separation.
