Question about AOA and CC

Dear Tom:

Hello. I doubt that he could file in NC. How long has the boyfriend lived in NY?

Hi,

I have a question about AOA and CC. Here is the situation:

The boyfriend and the couple were just regular friends in NC (all lived there).

Later the couple moved to New York. The boyfriend still lived in NC.

The relationship started between the wife and boyfriend after the couple moved to New York. Nothing happened in NC though.

Then the boyfriend also moved to New York. Now all the 3 parties are living in N.Y.

Can the husband file a case in NC against the boyfriend?

Thanks.

Tom
