The provision you are referring to does not mean that you cannot serve via certified mail if someone lives in a different county. It means that if you choose to serve them via sheriff, the sheriff’s department in that county must do the serving. For example, if you file in Wake County and your spouse lives in Orange County, the Orange County sheriff’s department must serve him. Since he is incarcerated, it does not sound like you will have an issue.

Hi,
I am using the forms on your site to do my own divorce and had just one quick question. On the service section it says that they must be served by sheriff if they live in a different county from me. My spouse is currently incarcerated and would thus be automatically served by a law enforcement officer if I serve him by certified mail. Would it be acceptable in this case to serve him by certified mail?
