Question regarding marital property

Husband and I are getting ready to separate. The home that we have been living in is mine and was acquired before the marriage - so I know it is mine and our prenup says so. After marriage my husband had one of those very nice prebuilt shops placed on my property which I agreed to, and he had the electricity connected to the home for the shop. Since he did pay for the shop, is he entitled to remove it from the property without my consent or is it now considered part of my property? Can I keep it? He also bought a truck during the marriage. Can I bargain with him and say the shop is mine and the truck is his?

Spend some time reading our article on Equitable Distribution to learn a little bit more about how the process works. Anything you own before the marriage is your separate property, but anything that is acquired during the marriage is considered marital property and subject to division. The truck and the shop would both be marital assets; essentially you should each get half of the value of both assets.
