I sent you a question regarding my ex-wife’s attorney threatening a recession of the property settlement we signed on July 30, 2010. I have heard that my ex-wife is saying that her attorney told her that a recession is near auto-matiic in the first six months after divorce. Our divorce was final Sept. 21, 2011. You had told me that a recession is rare. Is it easier or auto matic in the first six months following the divorce. If it is granted would you go back to equitable distribution. Thank-you
No. Recession is rare. It makes no difference if you attempt it within the first six months after a divorce. If you could atuomatically get a recession in that time period, then virtually no separation agreement in the state would stand for longer than six months.
