When does the one year separation period begin…when the separation agreement is signed or when one of the parties moves out of the residence? And what if the party that has agreed to move out refuses to do so after the signing of the agreement?
When you live separate and apart with the intent to remain separate and apart. Signing of the separation agreement has nothing to do with separation for divorce purposes.
I’m not sure what to do. I moved out for 3 months this past summer, but had to return to our home as my shop (I’m a hairdresser) is there and that’s my sole source of income. We agreed to me getting the house and shop and he gets the rest of our assets. We’ve signed the separation agreement and now he won’t move out. What can I do? Also, can the 3 months living apart be counted towards the required year separation?
