Can my ex-husband subpoena my new husband’s financial statements, bank account statements, and income tax returns? My ex-husband and I are scheduled to recalculate child support for our four children since it has been three years. My new husband and I have separate bank accounts, separate homes, separate credit cards and file separate income tax returns. We do not own any home, car, bank account, credit card or anything together. Does my ex-husband have legal standing to force my new husband to produce all of his financial records including bank statements, income tax returns and financial statements?

Your ex-husband could subpoena anything he wants, but your current husband’s financial information will have no bearing on your child support modification case. Only the biological/adoptive parents’ incomes count under the NC Child Support Guidelines when calculating child support.
