Well, if you filed jointly, the check will come back made out jointly so you both have to sign it to cash it(unless you had it direct deposited). You would get your 600, he would get his 600, and (IMO), the kids are yours so LEGALLY you get that 300 per child. Now you can negotiate a split of that child portuion if you’d like, but I don’t think there are legal ways that dictate how you have to do it.

A tax attorney will need to address this question for you. Generally any tax refund received during the marriage is marital property, however the stimulus check may be treated differently.

Question I would like to ask is this. We filed Married filing joint. There are step children involved. How would this be divided between both of us if we are going through a divorce now? I would claim my own children next year on taxes, he would not.
