If a father does not see his child, but pays child support (wage garnishment through CSE) do grounds for TPR exist? Is there a statute or case law that covers this? Thanks!
There are two parts of a termination of parental rights hearing. The first is whether there are grounds and the second is whether it is in the child’s best interest. You may have grounds, but if the parent is paying support, your issue will be with the second portion. NCGS 7B-1100s cover termination of parental rights.
