Unfortunately, this is beyond my area of expertise. You may want to contact your insurance company or the local police department, and see if they are able to give you an answer.

Hi. I have an incorporated sep agreement that includes a provision for me transferring the title of the vehicle to my ex once the vehicle is paid off. The vehicle was paid off in June, I took the plate off the vehicle outside of court (the ex drives the car as per the agreement but it’s my plate/registration) and I gave the title, which was notarized over to my ex and signed by me) to my ex via a 3rd party on the spot(Raleigh PD officer - long story and 50-b against my ex involved). It has been almost 3 months and my ex still doesn’t have a plate and hasn’t registered the vehicle.

My question is:
if my ex gets into an accident and it is my ex’s fault, can I somehow be held liable because my ex hasn’t finished the title transfer process yet by registering with the DMV? I canceled insurance on the vehicle the day after I gave the title to my ex and warned my ex well in advance via certified mail that I was canceling the insurance on that date. I am not certain if my ex has insurance or not. Also, is there any other liability associated with this vehicle? The DMV still shows it in my name, just not having an active registration/plate, but my ex has the title, which, my ex can say i never signed over, but I did…my ex has been known to lie, alot…

thanks…
