Waiver of Right to Answer

The Defendant does not have to answer if he does not object to the allegations. There is no form on our website for a waiver of right to answer because this is something that must be provided to you by an attorney.

If Defendant does not answer the complaint, because he does not object, is it necessary and/or required of the Defendant to go to the divorce hearing?

Has anyone had a spouse who agreed with the complaint for divorce and did “not” attend the hearing?

No, the defendant does not have to go to the hearing.

If Defendant is not objecting to divorce and has received complaint and summons, is Defendant required to answer the complaint? Where on your web site is form for Waiver of Right to Answer?

Also, I read in the NC statutes that if there is a minor child you provide the childs name, DOB and either Plaintiff’s social security number or Defendants social security number. I did not provide social security number of either party in the complaint - will that effect the filing of the complaint?
