What is the next step in divorce from bed and boar

Dear rummy:

Greetings. Yes, it sounds like your spouse may be “wasting” time instead of buying it. The next step, since you are living separate and apart, is to set up a hearing for alimony or equitable distribution (which ever you have not heard yet).

In order to get your property back, you can file a Motion for Return of Separate property. Best of luck.

The response posted above is based upon the limited factual information made available and is not intended as a full and complete response to the question. The only reliable manner to obtain complete and adequate legal advice is to consult with an attorney, fully explain your situation, and allow the attorney sufficient opportunity to research the applicable law and facts required to render an accurate opinion. The basic information provided above is intended as a public service but a full discussion with an attorney should be undertaken before taking any action.

My husband filed a civil summons for divorce from bed and board. And I filed a Response and counterclaim to it in June '05.

As there is a restraining order against my husband since May for assaulting and abusing me, we both communicate through our lawyers only.

In mid-June both our lawyers agreed to try an out-of-court settlement.
However since then my husband’s lawyer has been keeping mum and is not forthcoming, despite my lawyer’s effort at an agreement. Is my husband just buying time?
What is the next step that I can take, as I want to settle this matter soon, either on or off court?
Also, my husband is withholding my pre-marital property (jewelry). How and when can I get it back? I’ve proof that I purchased it before I married him.
Pls advise.
