When is it REALLY final?

  1. The divorce is granted at the hearing that will not take place until at least 30 days after he is served with the papers. There is nothing for him to sign. The hearing is usually within a few weeks of the end of the 30 days.

  2. It is finished and processed at the hearing. You can have a copy that day.

  3. Yes.

Good luck.

The response posted above is based upon the limited factual information made available and is not intended as a full and complete response to the question. The only reliable manner to obtain complete and adequate legal advice is to consult with an attorney, fully explain your situation, and allow the attorney sufficient opportunity to research the applicable law and facts required to render an accurate opinion. The basic information provided above is intended as a public service but a full discussion with an attorney should be undertaken before taking any action.

My 1 year mark has passed and my lawyer has filled out divorce paperwork and served it to my soon to be ex. To my knowledge he has not signed it…

1)I have heard that whether he signs it or not after 30 days it is granted at a hearing provided that he does not dispute that we have been separated one year.

  1. after the hearing how long does it take to process? do i get a copy sent to me?

  2. on child support: can the divorce be finalized with issues such as child support still left open if we do not agree?

Any educated advice is greatly appreciated.
