In your professional opinion as an attorney, am I doing the right thing by having my estranged husband’s name removed from the child’s birth cert. and changing the child’s surname (having established that he is not the natural father either by an Affidavit from estranged husband or DNA test) BEFORE I proceed with the Complaint for Divorce? Is there any reason that I should obtain the final Judgment for Divorce before getting the order to change the birth cert.?
Also, in the remote possibility that my estranged husband should surface and decide to cooperate, do you have an example of the Affidavit (for Wake County) that he needs to sign stating that he is not the natural father? All I found on your site is the “Affirmation And Acknowledgment Of Paternity” to be signed by me and the natural father.
