You should document as much information as you can and consult with an attorney. There needs to be a separation agreement drawn up and find out where you stand if you are unable to locate her. Having the “record” show that she affectively abandoned you and the children will look better for you. Please consult an attorney. Keep documentation of everything.

I assume you are asking about the next step regarding custody. You cannot serve her at a PO Box so if you do not know where she lives currently you will need to serve her via publication.

My wife left me. I am taking care of all 5 kids 10 and under. I am currently serving her custody papers to her po box in state. I just found out she is living in SC. She won’t tell me her address. What is the next step?

Custody can’t be withheld due to lack of childsupport payments.
If visitation is being withheld, and/or the children are being ‘hidden’, then once custody issues go to court, the parent withholding visitaiton better have a really good reason why they’re withholding…and lack of child support isn’t good enough.

If you don’t have an agreement, BOTH parents have equal access to the children.
