Does the new law of October 2009 protect someone if the spouse leaves for that person or even if someone is ACCUSED of something they have not done and is being threatened with alienation of affection prior to October 2009?
No. The new law says that an action cannot be based on behavior that began after the date of separation. The law was effective October 1, 2009. Prior to that date it was possible for a third party to be sued for alienation of affection even if the affair began after the date of separation.
