AOA & Criminal Conversation

Dear ncwilmington:

Greetings. Yes, you clearly have a claim against her for alienation of affection. Your wife may have grounds for a restraining order, but it will be hard to prove that the sexual relations were not voluntary. Thank you.

The response posted above is based upon the limited factual information made available and is not intended as a full and complete response to the question. The only reliable manner to obtain complete and adequate legal advice is to consult with an attorney, fully explain your situation, and allow the attorney sufficient opportunity to research the applicable law and facts required to render an accurate opinion. The basic information provided above is intended as a public service but a full discussion with an attorney should be undertaken before taking any action.

I was hoping an attorney could answer this question. My wife and I were friends with a woman who decided to have an affair with my wife, whilst telling me that I should get a divorce. My wife suffers from extreme depression and after a year of therapy, both my wife and the therapist feel that she was forced into sexual situations with this woman against her will. Our marriage was nearly ruined and we continue to heal. This woman called my wife out of the blue a month ago and told my wife I had mental problems. My wife told her to leave us alone. My wife is afraid of this woman and does not want me to pursue legal action. I have blocked her email and screen calls now. I do not want it to escalate to her driving by the house.

I want to know if I have any claim against this woman, and if so, what? I am wondering if I file a restraining order, it will make it worse.
Thank you
