Appeal Process

After you file the notice of appeal, what is the next step? I have been in contact with the district court and Raleigh and each just send me to the other. The keep referring me to each other for more information. I do not have the means to actually pay for an attorney for this process and the fact that it is so difficult to get information borderlines on a civil rights violation. I have the right to appeal a judge’s order especially when the judge has obviously made a mistake in the case.

Can anyone give me some guidance please?

Once you file a notice of appeal in district court, your case is then appealed to the Court of Appeals. Briefs need to be filed and eventually there will be a hearing date. It is not advisable to handle that process without an appellate attorney skilled in appellate law.

I understand it is not advisable but I really have no money… The family courts keep making me fly back and forth from CO to NC for absolutely no reason. Last time I went to the court in NC I also found out that there was evidence that has disappeared from the file that I know I filed and that I also know was filed by the defendant’s attorney. So, I am on my own on this one. Thank you for the response.
